The High Court has ordered Bailzone Mining (Pvt) Ltd to stop chrome mining operations in Chiromo Village, Zaka, following a legal challenge by local villagers who argued the company was infringing on their ancestral land and livelihoods.
The court found that the company’s activities were disrupting community life and encroaching on vital spaces, including homesteads, grazing land, fields, graveyards, and other culturally significant sites.
The applicants, Gideon Rushinga, John Rushinga, Million Rushinga, and Pride Garauzive, cited the Minister of Mines and Mining Development and the Sheriff of Zimbabwe as respondents, seeking a declaration to invalidate Bailzone Mining’s certificates of registration issued by the Provincial Mining Director in Masvingo.
The villagers also called for the annulment of the Environmental Impact Assessment (EIA) report approved by the Environmental Management Agency (EMA), arguing that the company lacked proper authorisation and that its operations should be banned altogether in their area.
Bailzone reportedly held 60 mining registration certificates across various sections of the village. However, tensions escalated as its operations increasingly disrupted the villagers’ way of life.
An earlier attempt by the company to obtain a court order restraining villagers from interfering with its work was dismissed.
In its latest ruling, the High Court ruled that Bailzone had failed to provide proof of consent from the Zaka Rural District Council for prospecting in the area.
Buoyed by that decision, the villagers returned to court to challenge the validity of both the EIA and the mining registration certificates.
Bailzone, in response, argued that its licenses remained valid and had not been formally revoked.
Despite the company’s opposition, the court sided with the villagers, effectively barring Bailzone from continuing its operations in the contested area.
